If operating mobile, reminder to carry copy of Ontario Regulation 366 when amateur while driving.

A few weeks ago, Frank VE3YY was stopped by an Ottawa Police officer and given a $650 ticket for distracted driving while hand holding the microphone and talking on his mobile radio during his morning drive to work. He explained to the officer that radio amateurs are exempt under the current regulations but at the time could not prove his claim. The police officer was probably not aware of this exemption. I believe Frank will challenge this ticket in court and we will be interested in the outcome.

So be prepared folks; download and print and carry in your car(s) a copy of Ontario Regulation 366 available at: https://www.ontario.ca/laws/regulation/090366 Section 13 of the regulation reads:

Exemption for amateur radio operators: 13. (1) Drivers who hold a valid radio operator certificate issued under the Radiocommunication Act (Canada) may drive a motor vehicle on a highway while holding or using a two-way radio. O. Reg. 366/09, s. 13 (1), O. Reg. 253/12, s. 3 (1).

You may also be required to show a copy of your ham certificate of proficiency so have that handy in your car too. However, any amateur operating mobile may also want to operate hands-free using new radios that support Bluetooth operation through the vehicle's speaker and microphone system intended for mobile phone operation. Also, a simple single- ear wired head set and manual PTT (toggled) switch to the radio will work equally well.
